刑法规范的有效性及其实现——以法人类学为视角的考察

现代刑法正朝着日趋精细化、复杂化的方向发展。在此进程中,社会公众被逐渐边缘化,公众对刑法的认知亦愈来愈模糊。刑法规范的有效性即公众对刑法的可接受性日益成为刑法发展中亟待解决的重大理论问题和现实问题。刑法规范的有效性根植于刑法规范与社会之间的互动关系,这种互动关系是刑法规范有效性的动力源泉。刑法规范的有效性要求刑法规范必须对非正式规则予以吸收和疏导,从而形成开放性的规范结构,并在此基础上充分发挥非正式规则对刑法规范的解释论功能。刑法规范的有效性还要求构建公众广泛参与的商谈与沟通机制,从而形成公众广泛参与刑法的制定和适用的新格局。
