| 摘 要： | 司法民意是一把双刃剑,它既可以成为一种于司法有益的支配力量,也可能损害司法公正。这种弊端产生的根本原因在于司法民意与法官职业思维的不同。在对案件裁决的过程中,法官的思维首先应当符合法律适用的一般思维模式,其中还应该包括对可能影响司法结果的民意保持警惕。 |

| Abstract: | The public opinion on judicature is a double-edged sword,which it can turn into dominant power that benefits to judicature,and also maybe damages judicial justice.The fundamental reason for these defects comes from the difference between the thought of public opinion on judicature and the judge's occupation thought.When judging the law case,the judiciary thought firstly accords with common thought patterns of law applying clause,and should guard the public opinion which may affect the judicatory result. |
