| 摘 要： | 《产品质量法》中界定的缺陷产品属于不合格产品的范畴，而瑕疵产品与不合格产品或缺陷产品在外延上是一种矛盾关系，它属于合格产品的范畴，法律是允许瑕疵产品存在的。在《产品质量法》中使用“瑕疵”一词值得商榷。

| Abstract: | In the Product Quality Law,the defective product would be the product which do not reach standard.The relation of flaw product and the product which do not reach standard is contradictory.Flaw product is the product which reach standard.Producing or selling flaw product is not illegal.So the word of flaw product is unmeaning in the Product Quality Law. |
