| 摘 要： | 文章从历史、现状、缘由等方面对我国商事立法的"民商合一"进行论述,并提出"民商合一"与"民商分立"的争论不必再继续下去,应付诸于实践.可效仿美国统一商法典的制订,由我国的法律委员会及法学会制订一部商法典并试行,让实践来检验其合理性.

| Abstract: | This essay discusses "combination of civil and commercial laws "in our country' s commercial legislation in terms of history, present situation and reasons. At the sane time, it suggests stopping the debate about combination of civil and commercial laws vs. "separation of civil and commercial laws " . The author thinks that our country' s law committee and law society can use American experience for reference, draft a commercial code and try it our. Its rationality will be tested and judged by practice. |
