| 摘 要： | 总结了我国对商标淡化行为的立法现状,指出了我国的立法现状和司法实践存在的矛盾,从而论证了我国引入商标淡化理论的理论和现实依据。同时,提出我国商标法应当增加关于商标淡化的条款,反不正当竞争法应增加一般条款,以防止驰名商标被淡化。
