论反垄断执法相对人的利益保护

反垄断执法弹性很大,在反垄断执法过程中强调相对人利益保护对于防止执法权滥用、协调利益关系以及维护商业秩序稳定极为必要。规范反垄断执法自由裁量权和保障相对人的程序权利是保护反垄断执法相对人利益的基本路径。我国应当遵循这一基本路径,明确反垄断执法裁量范围,建立反垄断执法裁量标准体系,完善反垄断执法的司法监督机制,构建确保相对人有效参与的陈述、抗辩和申诉制度,完善反垄断执法协商和解制度,从而有效保护反垄断执法相对人的利益。

On the Protection of the Benefits of the Parties in the Enforcement of Anti-monopoly Law

There can be a great deal flexibility in the enforcement of anti-monopoly law.Therefore,it is imperative,in the enforcement of anti-monopoly law,to emphasize the protection of the benefits of the parties to avoid power abuse,to coordinate the interests of different parties and to maintain a stable business order.This paper argues that the fundamental approach to protecting the benefits of the parties during the enforcement of anti-monopoly law is to prescribe the discretionary power and protect the procedural rights of the parties.It is argued that China should take this approach,delineate the scope of discretionary power,standardize discretionary norms,improve the mechanism of judicial supervision,and establish the system of protecting procedural rights of the parties and the reconciliation system for the enforcement of anti-monopoly law,with a view to effectively protect the benefits of the parties involved.
