蓝色经济高技术产业专利预警机制研究

蓝色经济高技术产业为突破行业巨头设置的"专利+标准"的保护壁垒,在竞争中取得一席之地,必须构建一个快速高效的专利预警机制,以防范专利侵权行为发生,降低企业经营成本和研发成本,维护自身经营安全。可以采用信息采集模块、分析评价模块、反馈报警模块、应急应对模块构建专利预警机制,在专利质量、专利实施、专利市场、专利环境等要素中有目的地选取一些具有可以定量及定性判断的具体指标,构成专利的预警评价指标体系,判断专利警情,并针对蓝色经济高技术产业中不同行业的专利预警情况,施行进攻型、防御型和圈地型等专利策略。

Research on the patent forewarning mechanism in the high-tech industry of blue economy

Should "patent + standard",the protective barriers set by blue economy high technology industry to breakthrough industry giants hold a small space in the competition,it is necessary to build a fast and efficient patent early warning mechanism to prevent patent infringement,reduce business cost and R &D cost,and maintain its own operating safety.This mechanism includes information acquisition module,analysis module,alarm module,feedback module and emergency response module.In the elements of patent quality,patent exploitation,patent market environment,this paper selects some specific indicators,which can be made quantitative and qualitative judgment,to constitute the index system of patent early-warning evaluation to determine the current patent alarm.And directing at the different patent early warning situations in the blue economy high technology industry,this paper puts forward different strategies,such as the offensive type,the defensive type and enclosure type.
