论网络服务提供商的著作权侵权责任

一方面网络服务提供商在互联网的运行和发展中发挥着不可替代的重要作用,另一方面在日见增多的网络著作权纠纷案件中,网络服务提供商往往身不由己地卷入其中,甚至成为他人侵权的替罪羊。究竟应该给网络服务提供商提供一个怎样的发展空间或者为它划定一个不构成著作权侵权的底线,这就涉及到网络服务提供商的著作权侵权责任问题。通过对比国内外相关法律法规,提出了作者对该问题的若干思考,以期给出一个相对合理、较具操作性的侵权责任标准。

A study of the copyright infringement liability of the internet service provider

Internet service providers play an irreplaceable role in the operation and development of the Internet. However, cases are increasing that the providers are involuntarily dragged into the disputes of Internet copyright infringement, or even become the cat's paw. What kinds of development space or bottom line should be set for the service providers so that they will not infringe the copyright? This involves issues of the liability for the copyright infringement. This thesis, through comparison of the laws and regulations at home and aboard, proposes some ideas on the issue, suggesting to set up a reasonable and practical standard in judging the infringement liability.
