| 摘 要： | 经济全球化给有组织犯罪的发展带来了巨大的影响,界定有组织犯罪要以经济全球化的实质为基础。国内外关于有组织犯罪的概念界定纷繁复杂,歧义丛生,解决该问题的关键在于,应该区分刑法学与犯罪学两个层次的概念界限,并且以我国刑法规定为标准,结合《联合国打击跨国有组织犯罪公约》的相关规则,将有组织犯罪在广义上界定为我国刑法总则规定的犯罪集团犯罪,而狭义的有组织犯罪,则仅指黑社会(性质)组织犯罪。

| Abstract: | The economic globalization has exerted a profound influence on the organized crime.When we definite the organized crime,we should differentiate the concept of penology and criminology based on the criminal law of our country and the Convention on Transnational Organized Crime.The organized crime should be defined as the criminal group in a broad sense and be defined as the mafia-style organization in a narrow sense. |
