| 摘 要： | 作为传统文化的一部分,民间文学艺术的法律保护在国际上日益受到重视,《伯尔尼公约》第15条对民间文学艺术"作品"予以保护,联合国科教文组织和世界知识产权组织以及《班吉协定》和《阿拉伯著作权公约》扩大了民间文学艺术的保护对象,建议用知识产权特别法保护那些不是作品而得不到现代著作权法保护的要素。因此,民间文学艺术将在国际上获得更强的保护。

| Abstract: | As a part of traditional culture, the folk literature and arts are being attached more importarce in international scope. The UNESCO and the international organization of Intellectual Property Rights expand the range of the folk literature and arts being protected and suggest that they should be protected by special law. |
