试论法的美学价值

美学与哲学、心理学、伦理学、教育学、语言学等科学具有密切的关系 ,但法学与美学的关系研究至今在我国尚属空白。而事实上 ,法学与美学也存在着密切的关系 ,法蕴涵着美的因素 ,体现出美的内容和价值。从法的内容中所蕴涵并体现出的正义、崇高、和谐、真善、力量等美学价值。法学与美学的关系研究 ,对于法学和美学的学科体系的完善或建立一个新的学科 (法美学 )具有积极意义 ,同时 ,有助于克服、消除人们在立法、守法、执法和司法以及法的监督过程中的异化现象。

On The Aesthetic Value of Law

Aesthetics is closely related to some disciplines such as philosophy, psychology , ethics , pedagogy ,linguistics But the relationship between law and aesthetics has never been discussed before . Actually, law has a close relationship with aesthetics in that law contains something of aesthetics and it also embodies the content and value of aesthetics . By revealing us the justice , the loftiness , the harmouy , the goodness and the power contained and embodied in law , this essay is to deal with the aesthetic value of law . The research on the relationship between law and aesthetics plays an important role in consummating the science of law and aesthetics , in establishing a new discipline(law\|aesthetics),and it will also help to overcome and get rid of the dissimilation in making the law , abiding by the law , enforcing the law , also in administration of justice and judicial supervision.
