农村医疗保障法律制度的比较研究

要建设和谐社会,必须重视占我国人口70%以上的农民的医疗保障制度建设。通过对国际上具有典型意义国家的农村医疗保障制度立法情况的分析,研究发现国外发达国家和发展中国家在农村医疗保障法律制度方面具有一些共同特点:均建立了完善的法律体系;同时发挥政府和市场机制在农村医疗保障制度建设中的作用;将强制参保作为农村医疗保障制度的基本原则,同时保证医疗保障制度能够普遍性覆盖全部农民等。我国在农村医疗保障立法方面较为滞后,现行法律体系层次低,且在实施和监督方面存在立法缺陷。因此,我国应借鉴其他国家的经验,建立健全农村医疗保障法律制度,坚持公平优先的立法原则并强化政府在建立农村医疗保障制度中的作用。

Comparative Study on the Legal System for Rural Medical Security

The construction of rural medical security plays an important role in China,as the rural residents account for almost 70% of the total population.This paper compares medical security systems of several countries,including developed countries and developing ones,and summarizes their common characters.Based on the comparative study,the paper finds that these countries share some common points,such as perfect legal system for rural medical security,optimal mixture of the functions of government and market,compulsory medical security and pursuing health equity.The legal system for rural medical security of China should learn from other countries to perfect the legal system,to stick to legislation principle of equity and to intensify the role of government during the establishment of rural medical security system.
