荀子学说中德治与法治辩证思想探析

荀子是我国古代著名的思想家,他的学说中既继承和发展了孔孟儒学,又兼容了法家的思想理论。他改造了儒家的“礼”和法家的“法”,强调“德治”与“法治”的辩证关系和各自的作用,将“德治”与“法治”在更高的理论层次上有机地结合起来,形成了“德治”与“法治”相结合的思想和理论,这一理论对于当前我们研究和加强“道德建设”与“法制建设”具有重要的参考价值。

The Dialectical Thought of Rule of Virtue and Rule of Law in Xunzi's Doctrine

Xunzi was a distinguished thinker in arcient China;he carried on and developed Confucian studies of Kongzi and Mengzi,and took in the ideological theory of Legalist school.He reformed the Confucian "rites" and the Legalist "Legality",put emphasis on the relationship between "rule of virtue" and "rule of law" and their respoctive function,combining them mechanically at a higher theoretical level into a theory which is of great referential significance our present study and strengthening of "the building morality of" and "the building of legal system".
