| 摘 要： | 电子提单流通性的实现机制有两个,其一系基于有关电子提单的立法,通过立法直接承认电子提单在法律性质上是提单。其二则是基于当事人之间的协议,这种协议通常约定采用让与机制间接地实现电子提单的流通性。两个机制中,第一种机制遇到了严峻挑战,因为传统提单流通性的实现与其使用的媒介———纸张有着密不可分的联系。

| Abstract: | There are two legal systems to realize the negotiability of EBL, one being the Oaw-making, by which EBL is recognized as BL in nature, and the other being contract, by which attornment is used to realise the negotiability of EBL. The first legal system to realize the negotiability of EBL is challenged, because paper is the essential media to realize the negotiability. After in-depth research of the nature of BL, the author believed that the negotiability can be realised in electronic environment. |
