宪政视角下的宪法工具主义误区及其克服路径

我国宪政史已走过了一百多年的漫长历程,宪政发展的道路异常曲折,特别是在20世纪的前半叶屡屡遭到巨大的挫折。宪法工具主义在其中扮演了非常关键的角色,始终将宪法、宪政制度作为工具而非价值追求是造成中国宪政发展异常命途多舛的重要原因。面对新时期的宪政建设,分析宪法工具主义的产生原因避免陷入宪法工具主义的误区应当做到：坚持依法治国,树立宪法和法律的权威;培养公民的宪政信念;宪政发展进程中要坚持＂以人为本＂。

Constitutional Government and Misunderstanding of Constitutional Instrumentalism

The one-hundred-year history of China＇s constitutional government was tortuous and had experienced great frustrations in the first half of the 20th century.Constitutional instrumentalism,which had taken constitutions and constitutional systems as tools instead of the way of value pursuit,was the main cause of those tragic experiences.The analysis of the root of constitutional instrumentalism will be helpful to avoid misunderstandings and to successfully construct constitutional government in the new period.Therefore,the following points should be taken into account： to stick to ＂governing with law＂ and build up the authority of constitution and law;to boost up the public＇s confidence in constitutional government;to uphold the idea of ＂human first＂ in the construction.
