| 摘 要： | 古典人权理论认为,只有个人才是人权的主体;在内容上,人权是指以自由权为核心的公民权利与政治权利;在本原上则有先验论与经验论两个分支;其实质强调人权的对抗性;在人权与法律关系方面则认为法律的目的在于保障人权。
