中国法律方法论研究学术报告(2005年度)

一年来,我国法律方法论在既有研究的基础上,展现出新的发展脉络与研究走向。通过对法律方法论的基础理论、法律论证理论研究、非形式逻辑对法律推理研究的影响、法律解释本体与方法的关系、部门法学中法律方法论意识的觉醒与研究、人工智能对法律方法论的影响等问题的综述,概括了法律方法论的最新进展。从总体上,我国法律方法论研究尚存在许多不足之处,总结和改进这些不足有助于推进这方面的研究。

A Review of Studies in Legal Methodology in China in 2005

On the basis of previous academic research studies,the study of legal methodology has made great progresses in recent one year.The new progresses involve such aspects as fundamental theories in legal methodology,the studies of theory of legal argumentation,non-formal logic and its influence on research of legal reasoning,the relation between methodology and ontology in legal interpretation,the revival of research on legal methodology in branch jurisprudence.On the whole,some limitations still exist in the study of legal methodology in China,and reflecting on such defects will improve relevant studies.
