国家统一司法考试应解决的问题刍议

国家统一司法考试对司法公正的深远意义决定了人们对它的关注程度。为了使这一制度得到良好的运行 ,还应更严格限定应试人员的资格 ,在考试内容上增加法学理论及职业道德、综合知识和外语的考查 ,增加口试 ,建立法律职业者间的职业交流制度 ,并对与国家统一司法考试不相适应的法学教育现状进行改革 ,建立统一的职业教育培训制度。

State-sponsored unified juridical test: Problems to be solved

Owing to its far-reaching significance for judicial justice, state-sponsored unified juridical test has arrested considerable attention from the public. This paper is of opinion that, in order to make this system operate efficiently, more strict restriction should be imposed upon the qualification for the candidates, quizzes should cover such fields as legal theory, professional ethics, comprehensive knowledge and foreign language, and with oral exams. This paper also holds that a system for professional exchanges among persons in the legal circles should be established and reforms should be carried out to get rid of the existing legal education not in conformity with state-sponsored unified juridical test so as to set up a unified professional legal education and training system.
