| Abstract: | The opinions about the grounds of applying penalty always vary from person to person.It is very difficult to decide which opinion is right.In the paper the author probes into the traditional retribution and prevention,attempting to seek two legal values:justice and effectiveness in applying punishment and ujstifying the fact the justice should take priority over effectiveness when in disagreement and the system of passing severe sentences on recidivists in China. |
