就制定法与民俗习惯间张力论村治

本文以华北定县农村调查为基础,揭示出当前中国农村的实际治理模式、意识形态和思维习惯,是以权威性自治为主、依法自治为辅的混合型治理模式,要使农村社会实现从权威性自治向依法代表性自治的转换,关键就是要实现意识形态和思维模式的改变。本文试图通过对制定法与民俗习惯的各自利弊和相互间张力的分析,对如何用该张力去制定与民俗习惯和农村现实相适应的良法,从而实现这种意识形态和思维模式的转换,并最终影响村治的历史向度做出论证和阐述。

Villager Autonomy in the Perspective of Law and Folk-custom

This article reveals that the pattern of governance, ideology and habit of thinking in China rural area are a kind of mixed governance pattern. And in this pattern, self-governance according to patriarchal clan＇ s authoritative is the most important and self-governance according to law is secondary. So the key solution to transform from authoritative governance to representative governance lies in how to transform ideology and habit of thinking. This article analyzes the respective advantages and disadvantages of, and the relationship between the law and folk-custom. At the same time, it illuminates how to draw up good law suitable for folk-custom with the relationship and how to realize the transformation of ideology and habit of thinking.
