| 摘 要： | 我国<保险法>第17条、18条规定了保险人的说明义务,但未规定保险人违反说明义务之法律效果.文章认为,保险人违反说明义务可致投保人撤销权之发生、保险人责任免除权之丧失和投保人损害赔偿请求权之成立,以及投保人所受损失、所失利益之赔偿和过失相抵等法律效果.

| Abstract: | Our country's Insurance Law makes rules on insurer's duty of presentation in Article 17 and Article 18,but it doesn't make any rules on the legal effect of insurer's breach of the duty.The author's opinion is that insurer's breach of the duty of presentation may result in legal effect of the proposer's right of rescission of the contract,the cost of insurer's exemption from liability,and proposer's right of compensation for his loss,ceasing gains and contributory negligence. |
