我国应与世界法律文化协调发展

当代世界法律文化的交流与融合已成为一种潮流与趋势,一个国家要进行现代法治建设应根据本国国情将外来法与本土法结合起来,以本土法为基础对其进行分析、扬弃和改革。目前,我国在进一步完善社会主义法律体系过程中,应将传统法律文化作为我国实现法治的根基,引进、借鉴外国法律制度,不断总结完善我国的经验,特别是西方法的主体意识、权利本位和尊重人权等方面,正是我国法律文化应该充实和改革的方面。同时,在移植外国法律制度时还应注重其理念的研究,否则就不能深刻领会该制度的内涵,只有这样,才能实现我国法治建设的目标,建立具有中国特色的法律制度。

China Should Coordinate Its Development with Legal Culture of the World

The intercommunion and merge of contemporary legal cultures in the world have become a mainstream and trend.If a country is to carry on the modern legal construction,it should combine foreign laws with local law on the basis of its own national situation,and based on its local law to carry on the analysis, developing the useful and discarding the useless in the reform.At present,during the process of China's further perfection of her socialist legal system,we should take traditional legal culture as the basis for realization of legal administration,and introduce foreign legal system into our country for reference,continuously perfect our own legal experience.The consciousness of the principal part,the right standard and the respect of human rights in western laws are especially the aspects that Chinese legal culture should be enriched and reformed. In the mean time,when we transplant foreign legal system,we should pay attention to the study of its essence,or we will miss the connotation of the system.Only in this way can we realize the goals of China's legal construction to build up the legal system with Chinese characteristics.
