民法典结构模型新探--法律关系与调整对象的双重视角

依照调整对象和法律关系组成法律规定,法律规定又构成民法典的逻辑,对于法典结构,本文从唯一具备内容意义的调整对象和法律关系入手,在对法律概念准确界定之后,进行了经验与理论的两方面论证,在严密的逻辑分析的基础上,得到了应然意义上的法典结构。然而在对现实中民法典进行考察时发现,应然的法典结构却不能在现实中被轻易发现,因此本文进一步对语言进行了考察,借用西方分析法学的成果,排除了语言上的障碍,从而在实然的世界找到了应然的法典的结构,并得到了法学与观念是两个决定民法典结构的根本性因素这一重要结论,并将这一结论运用于对各式民法典的考察,以验证该结论的说服力。对当前我国民法典制定过程中的主要争论,本文也从自己的理论视角作了考察。

On the Structure Model of Civil Code--From the Double Perspectives of Legal Relationship and Adjustment Object

According to the logic that legal relationship and adjustment object constitute laws and regulations, while laws and regulations constitute civil code, this paper discusses and generalizes the ideal structure of civil code on the base of exactly logical analysis in the experience and theory, beginning with the analysis on legal relationship and adjustment object which are the only one having actual meaning in content. However, it is hard to find such structure of civil code in reality. Therefore, this paper studies the language in detail while taking the achievements of analytical jurisprudence as a reference, and discovers the ideal structure of code in practical world at last. Meanwhile, this paper also draws the conclusion that jurisprudence and notion are two fundamental factors which can decide the structure of civil code and puts it into practice.
