| 摘 要： | 设立国内仲裁裁决司法审查制度有其理论依据和现实意义。国内仲裁裁决司法审查的范围应包括程序问题和实体问题,以是否违背公平、公正和当事人意思自治为标准;国内仲裁裁决的司法审查应参照适用特别程序,仲裁庭应为"法定证人",应允许当事人对司法审查所作出的裁定上诉。

| Abstract: | There is theoretical basis and reality when establishing the judicial investigation system of domestic arbitration award. It includes problem of procedure and substance, and is judged by just impartiality and party autonomy. It refers to special procedure. Arbitration tribunal should be "legal witness", and it should be permitted that the clients appeal with reling about judicial investingation. |
