| 摘 要： | 违纪处分关乎大学生的前途和命运,学者们对高校违纪处分行为的法律性质认识不一。违纪处分行为是一种具体行政行为,高校违纪处分中普遍存在处分主体、依据、程序不合法等违法问题。违纪处分中应当在贯彻和落实科学发展观、坚持"以人为本"和"教育为主"原则,协调好违纪处分与学生受教育及就业之间的关系。这不仅有利于维护学生合法权益,也有利于规范学校管理,推进依法治校。
