| 摘 要： | 期待可能性是近年来我国刑法界所热衷的一个话题——起因在于对域外刑法理论的研习借鉴。考察期待可能性之机理实质,实为我国刑法通说理论中犯罪动机中一种反向类型,一个主观方面的酌定减免责情节。以犯罪动机的原理及功能,可以较为简洁清晰地解说期待可能性问题,且对司法运用亦具高度之可操作性。
