| 摘 要： | 从英美法系判例制度的哲学前提即经验主义的思维模式入手,对经验主义在判例制度的事实发现和法律适用过程中的作用形式进行了分析,同时也对判例制度对实证主义法哲学的促进进行了研究,对判例制度与经验主义哲学间的逻辑关系进行阐释.作者认为判例制度的产生和发展离不开经验主义哲学的支持,经验主义为判例制度提供哲理基础而成为判例制度的合理性依据.

| Abstract: | Starting with the philosophical premise of empiricism of case system in Anglo-American law, this thesis analysis the functional mode of empiricism during the course of facts-finding and law-applying in case system, as well as the promotion to empiricism jurisprudence by case system, with a view to interpret the logical relationship between case system and empiricism. The author holds that case system can not origin and develop without the upholding of empiricism, for as a philosophical foundation, empiricism affords the rationalism of case system. |
