不动产错误登记赔偿制度探讨

不动产登记制度作为物权法的基础制度在物权法领域中起着举足轻重的作用。完善的不动产登记制度对于维护不动产物权秩序,保障不动产交易安全和交易便捷具有重大意义。目前我国出台了《物权法》,但对于不动产错误登记的赔偿责任制度规定不够详尽。对不动产错误登记行为应进行区分再作界定。不动产错误登记行为视为私法行为更合理。不动产错误登记为民事侵行为。目前,登记机关赔偿制度在归责原则、赔偿标准、举证责任等方面存在缺陷,应对它进行完善,以期给不动产权利人更便捷充分的保护,同时完善我国不动产登记制度。

On Compensation System of Mistakes of Real Estate Registration

The system of real estate registration,as the fundamental system of Real Right Law,plays an important role in the field of the real right law.A perfect system of such is of great significance to keep its order,safety and easy trade.However,it is not detailed enough to deal with the responsibilities of compensation in the issued Real Right Law.This paper aims to probe the limitations of the registration units in the aspects as responsibility principles,compensation criteria and proof citing responsibilities by giving definition to the act of mistakes in registration,discussing its nature,and basing on related content of the System of Civil Reparations.As a result,this work will further protect the owners of real estate and meanwhile perfect China's real estate registration system.
