权利与权力的功能背反：中国现代化进程中的症结及其消解

市民社会与政治社会的分化是权利与权力产生的社会基础。权利是市民社会的主体规则，权力是政治社会的主体规则。两者因市民社会和政治社会的分立制衡而分化互约。但长期以来，权利和权力两个概念在我国理论和实践中混淆不清，导致严重的“权利权力化”和“权力权利化”等权利与权力的功能背反现象。这是我国朝市场化、民主化和文明化方向发展中的症结所在；是全面妨碍现代化进程的社会阻力。为此，营造市民社会与政治社会分化互约的格局，把权利交给社会，权力交给国家，使权利和权力两分、社会和国家两清，便是改革的首要的和最终的使命！

THE FUNCTIONAL DEVIATION OF RIGHT AND POWER-THE CRUT AND ITS SOLUTION IN THE DEVELOPMENT OF CHINA'S MODERNIZATION

The disintegration of civilian society and political one has formed the social basis for the emergence of right and power. Right is the principal rule of civilian society,while power is the chief rule of political society.They are separated,but they control each other.However,for a long the,the two conceptions of right and power are confused both in theory and practice in our country,which has resulted in the integration of right and power.Thus appears the deviation of these two things.This is one of the biggest obstacle to the way of the marketization,democratization and civilization in China.In a word,it is the social resistance which holds back modernization.Therefore,it is necessary to establish a social pattern of separated but inter-controlling civilian society and political society and leave right to the society and power to the government so that right and power are separated,and society and government are differentiated.This is a paramount and ultimate task of reform.
