| 摘 要： | 人性是哲学中的概念,也是法哲学中的重要概念。从柏拉图到康德再到黑格尔莫不从人性角度关注法律。法的主体是人,规定的是人的行为,调整的是人的社会关系,实现的是人的价值。所以法学必须关注人性;法的发展必须注重人性的塑造。我国法制建设应摒弃工具主义法观念,彰显人的权利,在立法、执法过程中关注人性塑造,不能片面追求法律制度的完美而忽视了作为法的发展最终目的的人。

| Abstract: | Human nature is the concept of phiosophy, what's more, it is the important concept in the scope of phiosophy of law. Amost of all phiosophers analyzed law on the base of human nature. Man is the subject of law, whose regulation is orderd about man. Man is center of legal relations and legal world. So the law must take care of the human nature. Legal development must take care of the human nature . This essay draws a conclusion whether the key to rule of law completely depending on caring of the human nature, or avoiding the pursuit for the beauty of legal system one sidedly. |
