| 摘 要： | 为第三人利益合同是应现代交易自由和效率的需求而产生的一种新型合同。为第三人利益合同制度的效力和责任是其发挥功能的核心问题。我国应借鉴国外相关规定 ,完善我国为第三人利益合同制度 ,以适应现代交易的需求。
