| 摘 要： | 由于对外国法性质的认识不同,各国对确定外国法证明责任的方法也不相同。传统上的两种方法分别是确定事实的方法与确定法律的方法,现在这两种方法已逐渐融合,并有所创新。我国在制定民法典或国际私法时,应借鉴这一新的方法,以适应国际私法的发展。

| Abstract: | The ways to confirm foreign law's burden proof are different due to different knowledge of foreign law's characteristics.Fact confirmation and law confirmation are the traditional ways,which have gradually melted into a new way with some sort of innovation.While constituting civil code or private international law,we should use this new way for reference to adjust the development of private international law. |
