| 摘 要： | 制度在当今社会里的突出地位和作用使人们愈益关注制度的正义问题.制度正义是制度本身的正义和制度运行的正义两个方面的相辅相承.制度正义的主题是权利和义务的分配,目标是效率与公平的平衡,达到社会的平衡是制度正义的社会价值的本质所在.
