中日东海海域划界争端及解决

中日东海海域划界争议由来已久。双方的主要分歧在于是按照“公平原则”依“自然延伸”标准划界，还是依“等距离”标准按“中间线”方法划界。双方分歧中不容忽视的两个焦点问题就是冲绳海槽的划界效力以及钓鱼岛的归属及其划界效力。本文通过剖析双方观点和问题焦点．提出在坚持国家主权原则的基础上，通过谈判与协商的政治方法和司法方法来处理东海海域划界争端，而目前最为可行的方法是搁置争议．共同开发。

On the Settlement of Sino-Japanese Dispute on East China Sea

The dispute of Sino-Japanese on East China Sea demarcation has been existed for quite a long time. In view of demarcation of the Sea, China and Japan adhere to the principle of natural extension and of equidistant median line respectively, which leads to the no substantive progress to the demarcation; while on energy cooperation, although the two countries have a positive attitude, they also failed to reach any agreement of cooperation program. This article begins with an introduction to the special geographical location of the East China Sea and the analysis on the reasons of the East China Sea dispute. It discusses not only the different theories held by the two parties, but also their ideas of the principles of demarcation. And this paper has also focused the analysis of the East China Sea dispute on the following two aspects: the delimitation effect of the Okinawa Trough and ownership of Diaoyu Islands. In conclusion, the article firstly devotes its attention on how to resolve the East China Sea dispute: not only should we adhere to the principle of national sovereignty, but also we should take into account of the surrounding environment, such as international stability. On basis of this, the paper focuses on methods and concrete steps for its implementation of settlement of the disputes on the East China Sea.
