| 摘 要： | 大陆法系和普通法系国家的检察机关虽然在政治制度、法律传统等方面存在差异，但都程度不同地发挥着限制入罪、出罪和防错、纠错的职能作用，从而起到维护社会安全和保障人权的双重功能，在刑事法治建设中占有重要地位。我国刑事司法实践表明，随着刑事法治的不断成熟，我国检察机关限制入罪、出罪和防错、纠错的职能作用已逐步强化，检察机关的职能正在从侧重刑罚的保护功能向刑罚保护功能和保障功能并举、更好地维护国家刑罚权良性运行的轨道转变。

| Abstract: | Although Continent Law System and Common Law System are different, in political system and law tradition, their procuratorial agency＇s functions in protecting social safety and human rights are the same to some extent. The history of China＇s procuratorial agency makes it clear that procuratorial agency＇s function is transforming from protecting social safety to protecting social safety and people＇s rights. |
