| 摘 要： | 我国违法所得没收程序适用中问题比较突出,表现为案件数量少、分布不均衡、涉案人员级别低、涉案金额小等。原因主要是对诉讼目的和性质归属把握不准、程序设置没有体现"特别性"要求、相关办案机制缺失等,建议进一步完善程序设置。
