| 摘 要： | 大多数国家的立法均要求有效的信托必须目的合法,但信托的起源则是规避法律的产物。尽管现代信托已逐渐扩展到理财等功能,但其规避法律的劣根形象时刻在闪现着,对司法形成了挑战。而实际上,正是信托对法律的这种挑战促使了法律的发展。

Although modem trust expanded the function to manage finances gradually, the bad original image makes a challenge for the judicature. In fact, this challenge just promoted the legislation. |
