论现代国际法对主权的强化与弱化

综合运用历史分析、法律规范注释及比较分析方法,以考察主权在现代国际法中的演变趋势为目的。从国际法发展的角度看,汲取两次世界大战的惨痛教训,适应人类共同利益不断增强的客观需要,现代国际法关于主权的规定呈现出鲜明的强化与弱化的并行不悖趋势:一方面强化了主权原则在国际法中的地位,形成主权独立的制度保障,从而强化了对外主权;另一方面,确认主权限制的合法性,将国际法的调整范围扩展至国家管辖领域,相对缩小了主权的行使范围,限制了对内最高权的行使。

The influence of international law on sovereignty's weakness and strength

According to the development of international law,the regulation of sovereignty of modern international law takes on two distinct tendencies in which sovereignty is nonexclusively weakened and strengthened.Sovereignty principle is being highly strengthened in the status of international law,forming a series of systems about protecting its independence which stress external safeguard for sovereignty.Moreover,international law has confirmed the legitimacy of restriction on sovereignty,stretching its scope to domestic affairs and relatively narrowing the sovereignty heretofore exercised.
