| 摘 要： | 最高人民法院的司法解释应当说从立法上正式确立了我国现代自由心证证据制度。为保证法官形成心证时享有的“自由”不被滥用熏就必须制定相应的心证形成保障和制约措施。

| Abstract: | The Supreme people's court judicial interpretation has virtually established a new system of discretionary evaluation of evidence in china . thus ,judges' discretion of evidence is regulated and the possible abuse of which is curtailed.The efficiency of this system is backed up by its subordinate safeguarding and supervising rules. |
