| 摘 要： | 现行《反垄断法》在面对网络垄断行为时显得捉襟见肘,网络反垄断法的构建成为必然。适时地修正《反垄断法》并制定网络反垄断法;对"相关市场"、"支配地位"、"滥用行为"等名词进行重新定义;完善网络反垄断法豁免制度;重视网络反垄断中行业自律规范的作用;加强政府监管;统一网络技术标准;加快电子商务部门法及其他相关法律法规的制定都将强有力的支持网络反垄断法的构建。

| Abstract: | The existing Anti- monopoly Law seems very weak in the face of network monopoly,and the construction of network anti- monopoly law becomes inevitable. It should timely amend Anti-monopoly Law and formulate the network antitrust law; redefine the nouns such as＂the relevant market＂,＂dominant position＂,and＂abusive behavior＂; improve the exemption system of network anti- monopoly law; pay attention to normative role of industry self- discipline; strengthen government supervision; unify network technical standards; speed up the formulation of electronic commerce department law and other relevant laws and regulations,all these will strongly support the construction of network anti monopoly law. |
