| 摘 要： | 构建和谐社会离不开法治,而法治又离不开法制,法制、法治与构建和谐社会之间存在着某种内在联系,处理好三者之间的关系对于构建和谐社会至关重要。构建和谐社会所要求的法制有其自身的理念与特征,而其所要求的法治应在宪法、行政法和程序法等领域有所突破和创新。

| Abstract: | Because the rule of law is necessary to build a harmonious society,legality is necessary to establish the rule of law,a certain relationship existing among legality,the rule of law and harmonious society.The proper disposal of the relationship is rather important to build a harmonious society.Legality that fulfills requirement of building a harmonious society has its own ideal and characteristics,while breaking the new creation of rule of law fulfilling requirement of building a harmonious society should occur in the fields of the constitution,administrative law and procedure law. |
