| 摘 要： | 服务型政府的理念，是近现代西方社会治理实践的智慧结晶和政治资源，对于当今中国深化行政管理体制改革，转换政府职能，构建服务型政府，具有重要的借鉴和启示。从创设政府的本源看，人民把国家管理权力委托给政府，政府要对人民负责。所以，服务型政府应该是民本政府；从依法行政的原则看，政府必须遵守和践行法治，实现对权力的有效规约和限制，所以，服务型政府应该是有限政府。当代中国构建服务型政府，是对传统政府管理范式的深刻变革，也是对近现代“民本政府、有限政府”理念的历史超越和当代创新，具有重要的法哲学思想依据。
