特殊保证期间相关问题探讨

最高额保证可以不规定保证合同的持续期间,担保法27条中的“保证期间”实际应当是指最高额保证合同的持续期间,担保法在立法技术上有检讨必要。按揭合同中的阶段性保证指出卖人在贷款合同签订之日起到买受人取得房产权属证明与银行办妥抵押登记并将有关凭证交给银行收执之日止,对买受人所欠银行债务承担保证责任。此规定违反担保法规定也有背社会公平。担保法从实然和应然角度分析,票据保证都不会适用保证期间。

Discussion about the Problems on Special Guaranty Period

It is not necessary to set the lasting period of the surety ship contract in guaranty of maximum amount.The "period of the surety ship" prescribed by Guaranty Law of the People's Republic of China shall be the lasting period of the maximum amount guaranty contract.The legislative skill could be better? The guaranty of step in the mortgage contract means the seller should undertake surety ship liability during the period from the loan agreement being signed,till the buyer getting the title certificate of the house,registration of mortgage being finished and the related vouchers being kept by the bank,which is an unlawful and unfair clause? Physics or memos,the "period of the surety ship" of the law is not applied to the bill guaranty.
