吴敬琏与郎咸平法治思想之比较

为了避免中国市场经济走向权贵资本主义和实现经济增长模式的转变,吴敬琏呼唤法治的市场经济,而要建立法治必须进行政治体制改革;郎咸平认为实行市场经济和产权改革必须先制定法治化的游戏规则,才能避免广大民众被掠夺,为此必须用新法治主义替代新自由主义。两人的法治思想体现了法治化建设中的一些重要命题:市场与规范的关系,国家和民间组织在法治化建设的地位以及民主与法治的关系。两者的法治思想既有一致性又有对立性。
