林地承包经营权抵押”辨析

摘    要:"林地承包经营权抵押"虽然在政策性文件中被确认,但该概念在制度基础上欠缺合法性;在现实基础上欠缺现实需求。"林地承包经营权抵押"这一概念产生于对"林权抵押"客体的误解。林权抵押的客体是林木所有权和林地租赁权,林地承包经营权还不能、也不应当成为林权抵押的客体。

Abstract:Although mortgage of the contracted forest management right has been acknowledged in the government’s policy document,but the concept is not only institutionally short of legality,but also in absence of reality foundation.The object of forest ownership mortgage should be the ownership of vivid stumpage and forestland leasehold,and the contracted forest management right either could not or should not be the object of mortgage.
