ON THE TESTIFYING RESPONSIBILITY OF TRAP DEFENSING FROM DUAL DIMENSION

The accused in criminal proceedings will use trap detecting as a defense of the crime and this defense is known as trap defense.Out of the unbalanced comparison of proven ability and proven methods between the prosecution and the accused,the burden of proof in trap defense should be divided into two levels： objective legitimacy and subjective bias.The above two levels should be undertaken by the prosecution and the accused respectively.This unique constitution of burden of proof is one of the important ways of distributing justice in enticement investigating cases.
