“常回家看看”若干法律问题探究——以《中华人民共和国老年人权益保障法》的修改为背景

新修订的《中华人民共和国老年人权益保障法》增加规定子女应当经常看望年老父母，“常回家看看”第一次被写入法律。“常回家看看”入法本质上符合道德法律化的目的及其限度，凸显了法律对老年人精神赡养的认可。该法律条款具有一定的强常性，伦理性色彩浓厚，兼具规范与倡导功能，并可作为起诉与裁判的依据。法院判决要求赡养人履行看望义务具有一定的合法性与合理性，现实当中也遭遇了标准模糊、执行困难等障碍，故一方面需要完善立法，在审判和执行中充分运用调解，敦促赡养人自动履行，另一方面有赖道德进步和养老制度的完善，使老年人的精神需求获得满足。

Some Legal Problems on ＂Going Back Home Often＂--On the background of the modification of ＂People＇s Republic of Elderly ProtectionAct＂

The newly revised ＂People＇s Republic of Elderly ProteetionLaw＂stipulates that childrenshould go back toseeelderly parents very often. ＂Going Back Home Often＂ was written inlay;＂ for the first time. To stipulate it into the lawessentially suit the purpose andlimitsofthe legalization of morality, highlighting the legalreeognition of spiritual supportfor the elderly. Thelegal provisionis somewhat mandatory, withstrong ethicalcolor, having functions ofspecification and advocacy, and can be served asthe basis forprosecutionand thereferee. It has certain legitimacy and rationality for court to require dependents to fulfill the obligation of visiting parents. This law also encountered a fuzzy standard, difficulties in implementation and other obstacles in reality. On the one hand, we need to improve legislation, make full use of mediation in its trial and execution, and urgedependentsautomaticallyperform it; on the other hand, we should satisfy the elderly＇s spiritual needs by progress of moral and improvement of pension system.
