| 摘 要： | 从人治社会到法治社会不仅仅是一种名词的变化,更是人类社会生存和管理方式的变化,但这种变化不是自动生成的,而是建立在理性反思后的选择。人治社会并非一无是处,只是其表现出的三个特征在今天已经全然失去存在的土壤和理由;人治社会并非完全抹煞法的作用,只是法的作用从来都是受到各种限制的限制;法治与人治的冲突和矛盾是不可调和的,这种特性决定法治对于人治的取代是一种必然的结局,是一种理性反思后的选择。

| Abstract: | From rule by human to rule of law is a change of the manner how the human society survives and is managed,but the change is not automatic and is the choice after rational reflection.The three reasons for the existance of rule by human do not exist any longer today.The function of law is limited in the dominating society of rule by human.The conflict between rule of law and rule by human is not conciliatory which inevitably leads to the replacement. |
