试论商业秘密的法律保护

商业秘密作为无形财产,在市场经济条件下可以使权利人获得竞争优势。因此,加强对商业秘密的保护和管理非常必要。商业秘密可以通过权利人自身加强管理和完善制度进行保护,更需要通过加强国家立法进行保护。当前对于商业秘密的法律保护已经成为许多国家法律体系中的重要内容之一。而我国对于商业秘密的法律保护主要是通过相关法律规范进行的,存在一定的局限性。为了维护市场经济秩序,有效地预防和制裁商业秘密侵权行为,我国有必要制定商业秘密保护法。

Therefore, it is highly necessary to strengthen the protection and administration of the business secret. Business secret can be protected by means of strengthening the administration of the obligee, and perfecting the institution, and more necessarily by means of enhancing the national legislation. Now in mang countries, legal protection b of business secret has become an important content of the legal system. In our country, however, there are some limitations in the legal protection of business secret, which is conducted mainly through legal norms concerned. In order to safeguard the market economic order and prevent and punish effectively the infringement of business secret, it is necessary to enact the business secret protection law in China.
