| 摘 要： | 我国刑法中没有明确规定精神伤害罪,民法、行政法对精神伤害行为的规定也比较粗略。因此,弄清精神伤害行为的类型和实施方式,在刑法中明确规定严重伤害行为为犯罪,并明确界定刑法、民法对精神伤害行为的管辖范围,对于完善精神伤害行为立法很有必要。

| Abstract: | Since there is no clear and definite provision of mental injury crime in China's criminal law, and only rough stipulations in the civil law and administrative law where mental injury conduct is concerned, it is necessary, for further improvement on the legislation concerning mental injury, to make clear the types and ways of mental injury commitment, to define the severe mental injury offence as crime in the criminal law and to fix the limits of jurisdiction of the criminal and civil laws over mental injury. |
